I've just heard back from the body shop and apparently it's looking likely that my insurance company will be writing my sti off I'm really pissed off now the damage only seemed minor but there saying I need a new p1 splitter and bumper and those alone are £1179+ vat really don't know what to do now can I refuse to have it written off or if they do can I keep the car ??

I don't know the ins and outs of insurance claims, but it is probably worth asking if you can withdraw the claim.
There should be scope to buy it back, but then the claim will be recorded against the car. Right pain in the ****! Last edited by Banstead Stig; 23-06-2014 at 05:47 PM. |

There are a few options but a direct answer to your question is that you can't prevent the insurer making that decision unless you can find another garage to do the repairs cheap enough to make the insurer reconsider. Have you thought about getting it done privately and not claiming ( depends on circumstances ). You can buy back the salvage from the insurer and they will simply deduct the amount agreed with you from their final cheque to you but you need to consider more. Depending on the catatory of write off depends on the tasks required to get it back on the road and insured. Any idea if c or d write off yet?

I can withdraw the claim but then I'm left with the repair costs the front bumper and splitter are cracked the slam panel has been pushed back about a inch the headlight brackets are broken both wings are creased and the grill is broken it's not all bad they have given me a brand new merc c220 amg spec as a certosy car lol

If you withdraw the claim and there is no third party involved, as long as they have not paid any other costs and insurer will simply mark the claim as a non fault on the database. Once a car has been wriiten off they have a legal responsibility to tell dvla so check with your insurer.

No its absolutely fine Dom as long as the other guy has admitted fault ? Ie its a third party claim ?
It actually puts you in a really strong position First thing to know is in the case of a third party fault claim you have the right to to INSIST your car is repaired regardless of if repair costs are more then the vehicles value UNLESS the vehicle has been rendered structurally unsafe ,, im guessing it hasnt So you can just insist on it getting repaired You should also have a like for vehicle ,, so a modern subaru type performance vehicle to drive till its all resolved if yours is in for estimates etc If for example they had to order a bumper from japan to fix your car after you insist it be fixed it could take a long while for parts to arrive so best to sort out a suitable car right at the start ,, my 2002 lr got fixed last year and it took about 5 weeks ,, in that time i had a brand new m sport x5 to slum about in ![]() From the sound of it the insurance would probably be ready to negotiate with you about writing your car off as it might be easier for them but as it wasnt your fault and if the other driver has clearly accepted fault to the insurance companies not just to you then if it was me i would be looking for a decent cheque for value of sti and the car back for say ten to 20 percent of value ,,, ie you get paid and keep the car so you can repair it yourself albeit it will be on the vic register as a write off due to uneconomical to repair Then just document the damage and fix with fotos and should still retain some value for resale later The crucial thing is ,, has the other driver notified his or your insurance company that he is at fault ?

If you continue with the claim and it was a fault accident then no claims bonus will be stepped back ( unless they protected it) and a slight stat increase in premium at renewal. You then just need to check what the insurer wants you to do to get the car correctly continued to be insured with them again. Gimme a pm if you want as mostly depends on circumstances surrounding the claim

Just saw the other posts ,,, lol well done on the courtesy car ,, just being devils advocate but if you have a courtesy car and cancel the claim youre gonna be liable for costs of that straight away ?

Ask your insurer what they consider the value of the car to be yet ? They often undervalue them

Honestly doesnt matter what value the car is or the cost of repairs if the other party has admitted fault
Had the same conversation at xmas when a local authority vehicle hit a mates car ,, he phoned me saying insurance were going to write it off as repairs would be circa £4k and the car was worth £6k ,,, we chatted then he rang them back and insisted his car was to be repaired at the third parties expense unless structurally unsafe to do so ,,, it got fixed

Insurers are only obliged to put you back in the financial position you were before in incident. This is why they write off so readily. Of course they will cover any extra expenses you incur as a result such as courtesy car, bus fares, loss of earnings, personal injury etc

Exactly that ,,, hence if some silly fool drives into your car and damages it you have every right to insist it gets put back to the condition it was in pre accident
Its a different story if you yourself were at fault and when you claim on your own insurance you dont seem to have so many rights as cannot insist your vehicle be repaired as with a third party claim ,, not sure why but guessing its to stop people making fraudulent claims or having accidents deliberately to get a pre existing damage repaired etc

Glasses guide and a few other sites, they even check autotrader lol these days, engineer sends in report and the dept rings you usually to negotiate. They always get Scoobies wrong! They told Dave his jap sti was worth less than a uk 2000 as it was jap / sigh

The thing is the total costs toninsurance are a lot more then the repairs by the time you factor in admin costs,car hire,staff rates etc etc ,, my mates £4k bill ended up with £1600 of hire car charges on top and thats before the admin costs so you can see why insurers are keen to write cars off very quickly

The basic of it is that the cost of the repair should not exceed the cost of the car. But there is your haggling point, what have they valued the car at to consider it a write off vs repair cost at their own garage

For a third part claim Dom your view is gonna be what values it tbh ,,, guessing you didnt do an agreed value ? It wont be in glasses or any other book as too old so its very much going to be down to you to find other examples at similar mileage ,, ie find 5 good example ones and send them in copies of the autotrader,pistonheads ads
Glad hes admitted liability ,,, tbh youre in a nice position ,, enjoy the merc and let them do the worrying ,, the third party will be picking up the mounting costs for the hire car and this usually stirs them into action so at least you shouldnt have to chase them too much Just start looking for nice examples for sale from this point to base your valuation on ,, you know yourself im sure what it is worth and it was a nice one having seen it so you shouldnt be looking for ads of the cheapest similar sti out there but should be looking for ads for a nice one Im sure youll be fine

I've just heard back from my insurance company and the repairs have been authorised yippie !!!!! It was boarder line wether or not it was going to be written off but I'm glad it wasn't I've spoken to the body shop and I've managed to blag a full front end respray aswell as a new bumper p1 splitter ,grill and headlights so it should be mint when I get it back hopefully lol
